Monterey wants a Franklin Street nightclub to clean up its act.
The city Planning Commission on Tuesday will consider a possible crackdown on the Luxe Sports Bar and Lounge at 180 E. Franklin St.
City officials want the commission to declare the club a nuisance because of a "high number of incidents related to the operation of the bar" and set tighter conditions for its use permit.
A commission report says that between July 2011 and February, there were 10 arrests for fighting, four assault arrests, nine arrests for public intoxication, four theft reports, one arrest for battery on a police officer, two reports of after-hours drinking and a disturbing-the-peace citation.
The city sent business owner Dennis Barwick a May 3 letter outlining the pending nuisance proceedings and a list of possible operational changes to correct problems.
In a response letter, Barwick said he was never made aware of any pattern of disturbances or alcohol-related problems, and never received any citizen complaint questioning the club's safety.
The commission report outlines subsequent communications and meetings with the operator and city officials.
Three days after a meeting in May with police and planners, the report says a serious assault at the club left one person in the hospital intensive care unit.
Staff planners recommend the commission impose stricter conditions and include a six-month review of the club's operations. The proposed rules call for
more training of the staff on alcohol sales and cutting off alcohol sales at midnight and closing the club by 12:30 a.m. They also would require at least six security staff members and a closed-circuit television system to cover the club along with entrances and exits.The commission also will be asked to consider permit conditions for a children's gymnastic play-and-party facility on Del Monte Avenue that has provoked neighbors' complaints.
The city approved the permit for Jump-N-Around in April 2004, when it took over a location that had been used as a martial arts studio.
A commission report says neighbors have regularly complained about amplified music at late hours and DJ-hosted parties for "older participants." The business is to next an apartment building on Palo Verde Avenue, the report says.
While city staff members aren't recommending new permit restriction, they say the extended hours, use of a DJ and numbers of children at some events exceed permit limits.
